1. Agreement to terms

By accessing or using neverboringnow (“the Service”), operated by neverboringnow (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

neverboringnow is an AI-powered survey tool that generates simulated responses from AI personas. The Service allows users to submit questions and receive AI-generated feedback from diverse virtual respondents for the purpose of market research, idea validation, and product development insight.

3. AI-generated content disclaimer

All survey responses are generated by artificial intelligence. They are simulated opinions, not real human responses. Specifically:

  • AI personas are not real people and do not represent the views of any actual individual.
  • Results should be used for directional insight only, not as definitive market research or the sole basis for business decisions.
  • We do not guarantee the accuracy, reliability, or completeness of AI-generated responses.
  • Results may contain biases inherent in the underlying AI models.
  • neverboringnow is not a substitute for professional market research, financial advice, or legal counsel.

4. User accounts

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account.
  • You must be at least 13 years old to use the Service.
  • One person or entity may maintain only one free account.

5. Acceptable use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or discriminatory.
  • Misrepresent AI-generated responses as real human opinions in published research, media, or legal proceedings.
  • Attempt to reverse-engineer, exploit, or overload the Service.
  • Use automated scripts or bots to access the Service beyond normal use.
  • Violate any applicable laws or regulations.

6. Payment and billing

  • Free tier: 1 survey with 100 responses. No credit card required.
  • Paid plans are billed through our payment processor, Lemon Squeezy, which acts as the Merchant of Record.
  • Prices are listed in USD and may be subject to applicable taxes, handled by Lemon Squeezy.
  • You may cancel your subscription at any time. Access continues until the end of the billing period.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of purchase.

7. Intellectual property

  • Your content: You retain ownership of your survey questions. You grant us a license to process them through our service.
  • AI responses: AI-generated survey responses are provided for your use. You may use them in your internal decision-making, presentations, and reports.
  • Our service: The neverboringnow brand, website, and underlying technology are our intellectual property.

8. Limitation of liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • We are not liable for decisions made based on AI-generated survey responses.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for the accuracy of AI-generated content.

9. Service availability

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service (or any part) at any time with reasonable notice. We are not liable for any downtime or service interruption.

10. Termination

We may terminate or suspend your account at our discretion if you violate these Terms. You may delete your account at any time through your account settings or by contacting us at hello@neverboringnow.com. Upon termination, your right to use the Service ceases immediately. Sections 3, 7, 8, and 12 survive termination.

11. Changes to terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Service.

12. Governing law and disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of a mutually agreed arbitration body.
